Prime Minister of India
First we have to know about the Parliamentary Form of Government of India. In this Parliamentary form of Government there are Two heads i.e.
- The Real Head
- The Nominal Head
As we know that the honourable President of India is Nominated that's why He was called the Nominal Head of the Government. But the Honourable Prime Minister of India is Elected and also he has the Real Power of the Government that's why he is called the Real Head of the Government.
Qualification of Prime Minister :
- He must be a Citizen of India
- Age must be 25 years or more.
- He must be a member of Lok Sabha or Rajya Sabha
- If he is not a member of any houses of the parliament, he can be the Prime Minister of India for maximum 6 months.
- But in this duration he has to win an election and become a member of Rajya Sabha or Lok Sabha and also he has to obtain the maximum support of any of the Houses of Parliament
Selection Process of the Prime Minister of India :
- There is no particular process mentioned in the Constitution of India for the Selection of the Prime Minister of India.
- According to the Article 75, the Prime Minister shall be appointed by the President and other Ministers shall be appointed by the President on the advice of the Prime Minister.
- But this does not imply that the President is free to choose any member of the Parliament as the Prime Minister of India.
Then How the President of India will Select the Prime Minister of India?
Let's learn the Process step by step
- Now as we know to become the Prime Minister of India, he/she has to be a Member of Either Houses of the Parliament. But we, the people of India only can vote for the election of the Members of Lok Sabha.
- Now the Number of seats in Lok Sabha are limited for every States and Union Territories according to their population. The Total Number of Seats in Lok Sabha is 545.
- Now the party who obtain maximum number of MPs, is asked to prove the Majority i.e. they must have 273 MP's in support to form the Government and they will be given a 30 days of period to do so by the President of India.
- If any party can obtain 273 seats all by themselves, then they can form the Government easily, But if they don't have, then they will ask other parties to join to form the Government.
- Now, the Party who has the Majority to form Government, they will choose their Leader, and that Leader will be Selected as the Prime Minister of India by the President of India.
